Finance Africa (Pty) Ltd ("Finance Africa", "we", "us", or "our") is a South African asset finance company registered in the Republic of South Africa. Our registered office is at Building 16, Oxford Office Park, 3 Bauhinia Street, Highveld, Centurion, Gauteng.

Finance Africa is a responsible party as defined under the Protection of Personal Information Act 4 of 2013 ("POPIA"). We are committed to processing your personal information lawfully, transparently, and in accordance with applicable South African law.

Information you provide directly

  • Contact details: full name, email address, telephone number, and company name when you submit an enquiry form, contact us by email, or use our chat widget.
  • Financial and business information: details about your business, the assets you wish to finance, estimated deal values, and supporting documentation you voluntarily share during the application process.
  • Identity information: where required for credit assessment or regulatory compliance, we may collect identity numbers, company registration numbers, and directorship information.

Information collected automatically

  • Usage data: pages visited, time spent on pages, referring URLs, and browser/device type, collected through analytics tools.
  • Cookies and similar technologies: see Section 7 for full details.

Information from third parties

  • Credit bureaux and business information providers, where you have authorised us to conduct credit checks as part of a finance application.
  • Publicly available sources such as the Companies and Intellectual Property Commission (CIPC) register.

3. How We Use Your Information

We process your personal information for the following purposes, each supported by a lawful basis under POPIA:

4. Sharing Your Information

We do not sell your personal information. We may share it with the following categories of recipients, strictly on a need-to-know basis:

  • Funders and financial institutions — to facilitate asset finance transactions on your behalf, with your knowledge and consent.
  • Credit bureaux and verification services — for credit assessment purposes, as authorised by you during the application process.
  • Service providers — including IT infrastructure providers, email platforms, and analytics tools, who process data on our behalf under binding data processing agreements.
  • Professional advisors — including legal counsel and auditors, under duties of confidentiality.
  • Regulatory authorities — including the Financial Sector Conduct Authority (FSCA), South African Revenue Service (SARS), and law enforcement, where required by law.
  • Successors in business — in the event of a merger, acquisition, or sale of all or part of our business, subject to equivalent privacy protections.

Where we transfer personal information outside South Africa, we ensure adequate safeguards are in place as required by Section 72 of POPIA.

5. Retention

We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by law. In general:

  • Enquiry and contact records are retained for 3 years from the date of last contact.
  • Finance application records are retained for 5 years after the conclusion of the transaction, in accordance with the National Credit Act and FICA requirements.
  • Website analytics data is retained for 26 months.

After the applicable retention period, personal information is securely deleted or anonymised.

6. Your Rights Under POPIA

As a data subject under POPIA, you have the following rights:

  • Right of access — you may request confirmation of whether we hold your personal information and obtain a copy of it.
  • Right to correction — you may request that we correct inaccurate, incomplete, or outdated personal information.
  • Right to deletion — you may request deletion of your personal information where we no longer have a lawful basis to retain it.
  • Right to object — you may object to the processing of your personal information for direct marketing purposes at any time.
  • Right to withdraw consent — where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.
  • Right to lodge a complaint — you have the right to lodge a complaint with the Information Regulator of South Africa at www.justice.gov.za/inforeg.
