Finance Africa (Pty) Ltd is committed to protecting the personal information of all individuals with whom we interact — including clients, prospective clients, suppliers, employees, and website visitors. This notice explains how we comply with the Protection of Personal Information Act 4 of 2013 ("POPIA"), which came into full effect on 1 July 2021.

The Eight Conditions for Lawful Processing

Finance Africa processes personal information in accordance with the eight conditions for lawful processing set out in POPIA:

Accountability

Finance Africa takes responsibility for ensuring that personal information in our possession is processed in accordance with POPIA. Our Information Officer oversees compliance and is the first point of contact for data subjects.

Processing Limitation

We collect only the personal information that is adequate, relevant, and not excessive for the purposes for which it is collected. We process personal information only with the knowledge or consent of the data subject, or where another lawful basis applies.

Purpose Specification

Personal information is collected for specific, explicitly defined, and lawful purposes related to our asset finance services. We do not process personal information for purposes incompatible with those for which it was originally collected.

Further Processing Limitation

We do not process personal information for secondary purposes that are incompatible with the original purpose of collection, unless we have obtained fresh consent or another lawful basis applies.

Information Quality

We take reasonable steps to ensure that personal information in our possession is complete, accurate, not misleading, and updated where necessary. We encourage data subjects to notify us of any changes to their personal information.

Openness

We maintain a POPIA Manual (available on request) that documents our processing activities. We notify data subjects of the collection of their personal information and the purposes thereof, as required by POPIA.

Security Safeguards

We implement appropriate technical and organisational measures to protect personal information against loss, damage, unauthorised destruction, and unlawful access. In the event of a security compromise, we will notify the Information Regulator and affected data subjects as required by POPIA.

Data Subject Participation

Data subjects have the right to request access to, correction of, or deletion of their personal information. Requests can be directed to our Information Officer at [email protected].

Your Rights as a Data Subject

Under POPIA, you have the following rights:

  • The right to be notified that your personal information is being collected.
  • The right to access your personal information held by Finance Africa.
  • The right to request correction or deletion of your personal information.
  • The right to object to the processing of your personal information.
  • The right to object to the processing of your personal information for purposes of direct marketing.
  • The right not to be subject to a decision based solely on automated processing (profiling).
  • The right to lodge a complaint with the Information Regulator.

If you are dissatisfied with our response to a data subject request, or if you believe we have processed your personal information in violation of POPIA, you have the right to lodge a complaint with the Information Regulator of South Africa:
